תקנון שימוש באתר

א. כללי

  1. ברוכים הבאים לאתר TALIA BIOVY (להלן: "האתר"). האתר מופעל על ידי Talia Bio-Cosmetics Ltd.,  ח.פ. 514391978 (להלן: "החברה").
  2. השימוש באתר כפוף לתנאים המפורטים בתקנון זה ומהווה הסכם משפטי מחייב בין המשתמש לבין החברה.
  3. השימוש באתר, לרבות גלישה, רכישה או כל פעולה אחרת, מהווה הסכמה לתנאי תקנון זה. אם אינך מסכים לתנאים – יש להימנע משימוש באתר.
  4. החברה רשאית לעדכן את התקנון מעת לעת, לפי שיקול דעתה וללא הודעה מוקדמת.
  5. בכל מקרה של סתירה בין הוראות תקנון זה לבין פרסומים אחרים באתר – הוראות התקנון יגברו.

ב. שימוש באתר

  1. השימוש באתר מותר לבני 18 ומעלה, בעלי כשרות משפטית מלאה וכרטיס אשראי בתוקף.
  2. השימוש באתר מיועד לצריכה פרטית בלבד. שימוש מסחרי מחייב אישור מראש ובכתב מהחברה.
  3. המשתמש מתחייב למסור פרטים נכונים, מלאים ומדויקים בעת ביצוע הזמנה.
  4. חל איסור לבצע באתר את הפעולות הבאות:
  • שימוש בפרטים כוזבים
  • ניסיון חדירה, שיבוש או פגיעה במערכות האתר
  • שימוש מסחרי ללא אישור
  • איסוף מידע על משתמשים אחרים
  1. החברה רשאית לחסום גישה לאתר למשתמש אשר הפר תנאים אלו.

ג. רכישת מוצרים

  1. האתר מאפשר רכישה מקוונת של מוצרי טיפוח וקוסמטיקה בהתאם למלאי הקיים.
  2. המחיר המחייב הוא המחיר המוצג בעת השלמת ההזמנה.
  3. אישור קבלת הזמנה אינו מהווה התחייבות לאספקה.
  4. החברה רשאית לבטל הזמנה, בין היתר, במקרים של:
  • טעות במחיר
  • חוסר במלאי
  • הזנת פרטים שגויים
  • חשד להונאה
  1. התשלום באתר מתבצע באמצעות מערכת סליקה מאובטחת.

ד. משלוחים ואספקה

  1. המוצרים יסופקו לכתובת שנמסרה בעת ההזמנה.
  2. זמן אספקה משוער: עד 8 ימי עסקים. ייתכנו עיכובים בתקופות עומס.
  3. אין אפשרות לאיסוף עצמי.
  4. האחריות למסירת פרטים נכונים חלה על הלקוח בלבד.
  5. החברה אינה אחראית לעיכובים הנובעים מגורמים שאינם בשליטתה, לרבות כוח עליון.

ה. ביטול עסקה והחזרות

  1. ניתן לבטל עסקה בהתאם למדיניות הביטולים המפורטת בעמוד ייעודי באתר ובהתאם להוראות החוק.

ו. אחריות ושימוש במוצרים

  1. המוצרים מיועדים לשימוש קוסמטי בלבד ואינם מהווים תחליף לייעוץ רפואי.
  2. יש לבדוק את רכיבי המוצר לפני השימוש.
  3. החברה אינה אחראית לנזק הנובע משימוש שאינו בהתאם להוראות.

ז. קניין רוחני

  1. כל זכויות הקניין הרוחני באתר שייכות לחברה בלבד.
  2. אין להעתיק, לשכפל או להשתמש בתכני האתר ללא אישור מראש ובכתב.

ח. פרטיות

  1. השימוש באתר כפוף למדיניות הפרטיות של החברה.
  2. פרטי תשלום אינם נשמרים במערכות האתר.

ט. דין וסמכות שיפוט

  1. הדין החל על השימוש באתר הוא הדין הישראלי בלבד.
  2. סמכות השיפוט הבלעדית תהיה בבתי המשפט המוסמכים בתל אביב.

י. שירות לקוחות

לכל שאלה, הבהרה או פנייה ניתן ליצור קשר עם שירות הלקוחות באמצעים הבאים:

  1. Welcome to the TALIA Skincare website (the “Website”). The Website is operated by Talia Bio-Cosmetics Ltd., Company No. 514391978 (the “Company”).
  2. Use of the Website is subject to the terms set forth in these Terms of Use and constitutes a binding agreement between you and the Company.
  3. By using the Website, including browsing, purchasing, or any other activity, you agree to these Terms. If you do not agree, please refrain from using the Website.
  4. The Company reserves the right to update these Terms at any time without prior notice.
  5. In the event of any conflict between these Terms and other information on the Website, these Terms shall prevail.

B. Use of the Website

  1. The Website may be used by individuals aged 18 or older with full legal capacity and a valid payment method.
  2. The Website is intended for personal, non-commercial use only. Commercial use requires prior written approval from the Company.
  3. Users must provide accurate, complete, and up-to-date information when placing an order.
  4. The following actions are strictly prohibited:
  • Providing false information
  • Attempting to breach or interfere with Website systems

C. Product Purchases

  1. The Website enables the online purchase of skincare and cosmetic products, subject to availability.
  2. The binding price is the price displayed at the time of checkout.
  3. Order confirmation does not constitute a binding commitment to supply the products.
  4. The Company reserves the right to cancel orders in cases such as:
  • Pricing errors
  • Out-of-stock items
  • Incorrect customer details
  • Suspected fraud
  1. Payments are processed via a secure payment system.

D. Shipping and Delivery

  1. Products will be delivered to the address provided at checkout.
  2. Estimated delivery time is up to 7 business days. Delays may occur during peak periods.
  3. Self-pickup is not available.
  4. The customer is responsible for providing accurate delivery details.
  5. The Company is not responsible for delays beyond its control, including force majeure events.

E. Cancellations and Returns

  1. Transactions may be canceled in accordance with the Company’s Cancellation & Refund Policy and applicable law.

F. Product Use and Liability

  1. Products are intended for cosmetic use only and do not replace medical advice.
  2. Customers should review product ingredients before use.
  3. The Company is not liable for damages resulting from improper use of products.

G. Intellectual Property

  1. All intellectual property rights in the Website are owned exclusively by the Company.
  2. No content may be copied, reproduced, or used without prior written consent.

H. Privacy

  1. Use of the Website is subject to the Company’s Privacy Policy.
  2. Payment details are not stored in the Website systems.

I. Governing Law and Jurisdiction

  1. These Terms shall be governed by the laws of the State of Israel.
  2. Exclusive jurisdiction shall lie with the competent courts in Tel Aviv.
